What is a Habitat Regulations Assessment (HRA)?
A Habitat Regulations Assessment (HRA) is a legal process used to assess whether a plan or project could have an adverse effect on a European designated site. This includes Special Areas of Conservation (SACs), Special Protection Areas (SPAs) and, in many planning contexts, Ramsar sites.
The HRA process is required under the Conservation of Habitats and Species Regulations 2017 and is designed to ensure that development does not undermine the conservation objectives of protected sites.
The HRA itself is carried out by the competent authority, typically the local planning authority. However, developers are often required to provide supporting ecological evidence to inform the authority’s decision-making, which is where experienced ecologists can help.
When is a Habitat Regulations Assessment required?
A Habitat Regulations Assessment is required where a proposed development could have a likely significant effect on a European designated site, either alone or in combination with other plans and projects. This applies even where impacts are indirect.
An HRA may be triggered where:
- A site lies within or close to a Special Area of Conservation (SAC), Special Protection Area (SPA) or Ramsar site.
- Construction or operation may cause disturbance to qualifying species and habitats, as identified in the Habitats Directive.
- Additional impacts may be had on recreational pressure, water quality, nutrient loading or air quality.
An HRA test is precautionary. If a likely significant effect cannot be ruled out, the local planning authority must undertake further assessment.
Survey seasonality
A Habitat Regulations Assessment can be progressed at any time of year. However, requirements should be identified early in the planning process to allow for any supporting surveys within the correct seasonal windows.
